Edward A. Loss III

The Law Offices of Edward A. Loss III limits its practice to the aggressive defense of the accused, impaired driver from Misdemeanor DUI cases to Vehicular Homicides in AZ.

Mr. Loss is a tough, knowledgeable and experienced trial lawyer who has successfully handled hundreds of cases. Ed enjoys a national reputation as a DUI practitioner and has completed over 750 hours nationwide of advanced training pertaining exclusively to DUI related matters.

He has qualified as Class I Operator of the Intoxilyzer 5000 breath testing device and the GCI Field Collection Device pursuant to Arizona Department of Health Services Rule R9-14-406(A)(2); is a DOT Certified Operator of the new Intoxilyzer 8000 breath testing device pursuant to 49 CFR Ch. 42 and is certified as a Horizontal Gaze Nystagmus / Field Sobriety Test Instructor.

Ed is a 1983 graduate of the DePaul University College of Law in Chicago where he served on the Law Review. After Law School he clerked for the Honorable George N. Leighton of the United States District Court for the Northern District of Illinois.

Ed is a Sustaining Member and Arizona State Delegate of the National College for DUI Defense, A member of the DUI Committee of Arizona Attorneys for Criminal Justice, The National Association of Criminal Defense Lawyers and a Founding Member of the Phoenix based Committee for Constitutional Enforcement of DUI Laws. That Committee first uncovered the fact that the State of Arizona was concealing and destroying calibration and quality assurance data for their Intoxilyzer 5000 breath testing devices.

Ed was associate counsel in the case of State v. Hentges resulting in the suppression of over 1,300 breath test results on April 18, 2000. Ed was also the first Defense attorney to discover the state was using microbial contaminated blood swabs in the 1999 case of State v. Holovnia. These Microbes were actually capable of creating Ethyl Alcohol in the blood collection tube after the blood draw! This shocking revelation allowed Ed to achieve a Not Guilty verdict on the alleged .184 blood alcohol concentration in that case.

Ed is proud of his Martindale-Hubbell "AV" rating which identifies him as an attorney of the highest professional expertise and ethical standards.

Ed is a 32nd Degree Mason, a Knighted Member of the Order of Knights Templar and a Noble of the El Zaribah Shrine in Phoenix.


John Phebus

Mr. Phebus is a 1993 graduate of the University of Illinois College of Law.  He is admitted to practice law in both Arizona and Illinois. He specializes in the skilled and aggressive defense of complex criminal matters.

Mr. Phebus is a member of Arizona Attorneys for Criminal Justice, the American Bar Association, and the Arizona Committee for Constitutional Defense.
