Read Kansas DUI Lawyer Paul Cramm's Answers About Kansas DUI Laws

  • Can I fight my Kansas DUI?

Simply speaking, yes. I can review every aspect of the case, from the reason that you were stopped, to the validity of the field sobriety tests, to the maintenance of the breathalyzer machine, to the validity of the results. I will conduct a thorough review of all the facts and laws regarding your Kansas DUI case.

Also, I will discuss the case with the prosecutor and judge, pointing out your background, your job, and the need for you to keep your license.

  • What is illegal under Kansas DUI laws ?

In Kansas, the charge of Driving Under the Influence of Alcohol or Drugs (DUI) alleges that your Blood Alcohol Concentration (BAC) was .08% or greater within two hours of operating or attempting to operate a vehicle or that you operated or attempted to operate a vehicle while under the influence of alcohol, drugs or any combination of alcohol and drugs to a degree that rendered you incapable of safely doing so.   Because Kansas law provides for conviction under either “leg” of this split standard, thorough and aggressive defense of a DUI charge requires the skills of a qualified Kansas DUI defense lawyer.
Kansas DUI cases are procedurally consistent with any other criminal charge in that the prosecution bears the burden of proving the charge “beyond a reasonable doubt.”  However, because of an increased public intolerance of drinking and driving, defending against a Kansas DUI charge has become increasingly more complicated, and the penalties for conviction have become much more serious. In order to defend against a Kansas DUI case, your attorney must be ready and able to attack the Government's evidence of intoxication. There are a number of avenues that an experienced, thorough DUI defense attorney can pursue in order to defend the client.   Countless DUI cases have been won by contesting the constitutionality of any stops, searches and seizures; challenging the precision and proficiency with which the arresting officer conducted the field sobriety tests; challenging the training and experience of the individuals who conducted any chemical tests as well as the test results themselves; and by testing the credibility and reliability of the statements of any witnesses.

  • Since the test result indicates my BAC was .08 or more, am I going to be found guilty?

Not necessarily. There are many tactics and strategies to use when defending Kansas DUI cases. In certain circumstances we can successfully challenge the procedures used when administering the test and the accuracy of the test result. Please see my Challenges page for some specific examples of defense tactics and the outcome of some of my recent cases.

  • What should I look for when hiring a Kansas DUI Attorney or Lawyer?

Conviction of a drunk driving charge can have serious consequences affecting your relationships and your ability to earn a living. Effective defense requires thorough knowledge of the issues related to drunk driving charges, which differ among the Kansas and Missouri communities surrounding the Kansas City Metro Area. At the law firm of Paul D. Cramm, Chtd., we limit our practice exclusively to criminal defense, and we have the knowledge and the experience needed to effectively defend you against DUI charges.

Drunk driving (DWI / DUI) charges are serious, and can have a lasting impact on you and your livelihood.  In planning a drunk driving defense strategy, we carefully examine all of the evidence to determine if the stop was proper, and if the officer had probable cause to investigate a suspected alcohol-related driving offense.  We may challenge the stop itself, or we may file motions to suppress evidence related to field sobriety tests and blood alcohol concentration (BAC) tests, such as those involving PBTs and the Intoxilyzer. We also handle the administrative proceedings required to protect your driving privileges.

Our experience has taught us to consider the following:

  1. The initial traffic stop – Did the officer have a valid reason to stop the suspect?
  2. The DUI investigation – Did the officer have valid suspicion of elevated blood alcohol content?
  3. The field sobriety tests - Did the officer administer the field sobriety tests correctly?
  4. The chemical test at the station – Did the officer follow required protocol for administration of the Intoxilyzer?

If the answer to any one of these questions is "no" there may be a strong basis to file a motion to suppress the evidence in your case or to successfully challenge the sufficiency of the evidence at trial.  We look at everything in order to obtain the best possible outcome for our clients. Not every driver arrested for DUI is guilty of the offense.

  • Experience Makes the Difference

In defending against DUI charges, experience counts.  I prepare every case I handle as though it were going to trial.  I believe that is the only way to truly know the detailed facts of each case.  If a better outcome is available by means of plea negotiations, I have always believed that the prosecutor is much more likely to make a favorable offer in a case that he or she knows the Defense is prepared to try if necessary.

If you have been charged with an alcohol related driving offense, you need our skilled legal representation immediately to protect your future.  We urge you to contact our Kansas City DUI defense lawyer today.

We defend against a wide variety of felony and misdemeanor charges, including drug charges, shoplifting, and domestic violence. Our offices are in Olathe, Kansas, and we defend clients accused of crimes throughout the Kansas City Metro area, including the communities of Overland Park, Olathe, Mission, Lenexa, Mission Hills, Shawnee, Roeland Park, and Kansas City, Kansas in Johnson County and Wyandotte County, Kansas well as Jackson County, Missouri.
