Read Texas DWI Attorneys Lawyers Kelly Case' Answers About Texas DWI Law
Can I fight my Texas DWI?Simply speaking, yes. I can review every aspect of the case, from the reason that you were stopped, to the validity of the field sobriety tests, to the maintenance of the breathalyzer machine, to the validity of the results. I will conduct a thorough review of all the facts and laws regarding your Houston Texas DWI arrest.
Also, I will discuss the case with the prosecutor and judge, pointing out your background, your job, and the need for you to keep your license.
- What is illegal under Texas DWI Laws ?
In Texas, the charge of Driving While Intoxicated (DWI) alleges that your Blood Alcohol Concentration (BAC) was .08% or greater when operating or attempting to operate a vehicle or that you operated or attempted to operate a vehicle while under the influence of alcohol, drugs or any combination of alcohol and drugs to a degree that rendered you incapable of safely doing so. Because Texas DWI Law provides for conviction under either "leg" of this split standard, thorough and aggressive defense of a DUI charge requires the skills of a qualified Texas DWI defense lawyer. Texas DWI cases are procedurally consistent with any other criminal charge in that the prosecution bears the burden of proving the charge "beyond a reasonable doubt." However, because of an increased public intolerance of drinking and driving, defending against a Texas DWI charge has become increasingly more complicated, and the penalties for conviction have become much more serious. In order to defend against a Texas DWI case, your attorney must be ready and able to attack the Government's evidence of intoxication. There are a number of avenues that an experienced, thorough Texas Drunk Driving defense attorney can pursue in order to defend the client. Countless DWI cases have been won by contesting the constitutionality of any stops, searches and seizures; challenging the precision and proficiency with which the arresting officer conducted the field sobriety tests; challenging the training and experience of the individuals who conducted any chemical tests as well as the test results themselves; and by testing the credibility and reliability of the statements of any witnesses.
- Since the test result indicates my BAC was .08 or more, am I going to be found guilty?
Not necessarily. There are many tactics and strategies to use when defending Texas DWI cases. In certain circumstances we can successfully challenge the procedures used when administering the test and the accuracy of the test result.
- What should I look for when hiring a Texas DWI Attorney or Lawyer?
Conviction of a drunk driving charge can have serious consequences affecting your relationships and your ability to earn a living. Effective defense requires thorough knowledge of the issues related to drunk driving charges, which differ among the Texas communities surrounding the Houston Texas Area. At the law firm of Kelly Case, Houston DWI Lawyer, we limit our practice to Texas DWI/criminal defense, and we have the knowledge and the experience needed to effectively defend you against DWI/DUI charges.
- What makes Kelly Case qualified to handle my Texas DWI Arrest?
I began my professional legal career as a prosecutor for the Galveston County District Attorneys Office under Michael J. Guarino. I acted as Chief of Misdemeanor for one and a half years and personally supervised every DWI/DUI case in Galveston County, while training and supervising four attorneys and a staff of over 20 support personnel.
Additionally, I was responsible for training new prosecutors on trial tactics and criminal legal principles applicable to DWI Prosecution. On my second day working as a prosecutor, I was trying a case and realized that law school did not prepare attorneys for trial work. I knew that there had to be a way to quickly and efficiently train attorneys how to try cases and win! I developed the training manual for incoming prosecutors, enabling them to be much more effective trial attorneys in a much shorter amount of time. I was also Chief of the 212th District Court and responsible for trying numerous felonies. During my 5 year tenure at the District Attorneys Office, I was instrumental in prosecuting the first misdemeanor bond forfeiture hearings as well as revolutionizing the prosecution of criminal cases through the use of power point presentations and computer technology.
I entered into private practice upon moving to Houston in 1995 and began my practice as a criminal defense attorney. Since that time, I have successfully represented hundreds of clients charged with DWI/DUI. Even though the numbers of represented clients are large, I, and my staff treat each and every client's case as if it is the most important problem they are facing . . . because it is!
Upon moving to The Woodlands, Texas in 2003, I have been an active member in the Montgomery County Criminal Lawyers Association while maintaining active membership in the Harris County Criminal Lawyer's Association as well as many other professional, legal organizations. I currently handle cases in Walker, Montgomery, Harris, Fort Bend and Galveston Counties. Take a look at the home page for a list of current membership and professional organizations. I am very active in defending those persons accused and improperly informed of their rights by the police. I am certified to sit on Capital Murder cases and attend and lecture at numerous training seminars in and around the State of Texas. I am committed to providing the highest quality legal representation at the best price for my clients; a price that is fair for the work performed.
My wife and I have four children. We are residents of The Woodlands, Texas and are committed to serving our neighbors in Walker, Montgomery, Liberty, Harris, Fort Bend and Galveston Counties.
I have also earned the Microsoft Certified Solutions Expert certification and attained a black belt in the Japanese Martial Art of Aikido.
I have consistently earned the highest praise from my clients because I am accessible, and I keep them informed about the status of their cases, in addition to having the necessary expertise to obtain a favorable result. After all, it's your future, you have a right to know what's going on and your attorney has a duty to keep you informed. This philosophy began with my grandfather and has continued through his lineage to positively influence my client contacts.

Our experience has taught us to consider the following:
-
- The initial traffic stop - Did the officer have a valid reason to stop the suspect?
- The DWI investigation - Did the officer have valid suspicion of elevated blood alcohol content?
- The field sobriety tests - Did the officer administer the field sobriety tests correctly?
- The chemical test at the station - Did the officer follow required protocol for administration of the Intoxilyzer?
If the answer to any one of these questions is "no" there may be a strong basis to file a motion to suppress the evidence in your case or to successfully challenge the sufficiency of the evidence at trial. We look at everything in order to obtain the best possible outcome for our clients. Not every driver arrested for Houston Texas DWI is guilty of the offense.
In defending against DWI Houston charges, experience counts. I prepare every case I handle as though it were going to trial. I believe that is the only way to truly know the detailed facts of each case. If a better outcome is available by means of plea negotiations, I have always believed that the prosecutor is much more likely to make a favorable offer in a case that he or she knows the Defense is prepared to try if necessary.
If you have been charged with an alcohol related driving offense, you need our skilled legal representation immediately to protect your future. We urge you to contact Kelly Case, Houston DWI Attorney defense lawyer today.
